These Terms and Conditions (“Terms”) are a legally binding agreement (“Agreement”) between you and People of Eden.

This website (“site”) is operated by People of Eden. Throughout the site, the terms “People of Eden”, “POE”, "Eden", “we”, “our” and “us” refer to People of Eden. If you use any of our services, we will refer to you by using the terms “user”, “purchaser”, “you”, “your” or “yours” in these Terms.

Please read through these Terms in conjunction with People of Eden’s Privacy Notice and Cookie Policy.

These Terms govern your purchases through People of Eden’s site, constitutes the entire Agreement and supersedes any and all preceding and contemporaneous agreement between you and People of Eden. By accessing or using any part of the site, you agree to be bound by these Terms.

  • Please review our Privacy Notice. People of Eden takes its user privacy seriously and undertakes to diligently safeguard and protect the privacy and confidentiality of your details. However, in the absence of negligence on its part (and subject to applicable laws, including laws related to data protection and privacy) People of Eden cannot be held liable for any loss suffered if a third party procures unauthorised access to any data that you have provided when using our site.
  • By using this site, you warrant that all data provided by you is accurate and update. You are responsible for maintaining and promptly updating account information for accuracy and completeness.
  • People of Eden will not share your personal information with third parties without your written consent.

2. Products and Orders

  • All orders are subject to availability. In the event the products are no longer in stock, or there are supply difficulties, People of Eden will send you an email advising you of the same.
  • All orders placed constitute as an offer of purchase and are subject to acceptance by People of Eden. People of Eden will confirm such acceptance by sending you an email that confirms that your order has been dispatched.
  • The products made available on the site or received by you are for your personal use only.
  • You may not use any product or part thereof for any commercial use or any use that would benefit a commercial party. You may not reproduce, distribute, display, sell, resell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile, or otherwise exploit any product or part thereof.
  • People of Eden reserves the right, with or without notice, to refuse an offer for any reason. If an order is not accepted, a full refund will occur at People of Eden’s earliest possible convenience.
  • People of Eden reserves the right to limit the sale of its products to reasonable or household quantities.

3. Product Information

  • People of Eden will endeavour to ensure all information available on the site and about the products are accurate and up to date.
  • Occasionally there may be information on the site that contains either typographical errors, inaccuracies, or omission that may relate to product descriptions, pricing, availability, promotions and offers. People of Eden reserves the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information on the site is inaccurate at any time without prior notice, including after you have submitted your order.

4. Defective Products

  • In the event that the product you receive is defective or incorrect, it will be subject to our returns, exchange and refund policy.

5. Price and Payment

  • All prices listed on the site are in Australian dollars and are inclusive of any Australian Good and Services Tax, when applicable. The prices do not include any applicable shipping or delivery fees.
  • The price indicated on the site may be changed at any time without notice. However, you will be charged the rate in force when your order was validated.
  • You must pay for the products purchased on the site at the time of placing an order. 
  • You may pay using Afterpay, PayPal, Shop Pay, Google Pay, Apple Pay, Visa Card, Credit Card or People of Eden Gift Card, where possible.

6. Risk and Title

  • Any products ordered will be at your risk from the time of delivery.
  • Title to the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges, or upon delivery, whichever is later.

7. Eligibility

  • In order to purchase products through our site, you must provide Faithful Skin with your personal details, including your name, postal address, email address and/or any other contact details as indicated.
  • To purchase products on our site or to engage our services, you must be 18 years old. Otherwise, if you are under the age of 18, you may browse our site but not make a purchase. This site is not directed to under 18-year-olds. Therefore, by accessing or using our site, you acknowledge that you read, understood, and agree without any limitation to be bound by these Terms.

8. Disclaimer of Liability

  • People of Eden provides the site and its contents on an “as is” basis, and makes no warranties or representations of any kind, express or implied as to the operation of People of Eden’s site, information, content or products, except as otherwise provided under applicable laws. 
  • Our liability in connection with any product purchased through our site is strictly limited to the purchase of that product.
  • People of Eden will not be liable for any claim arising out of your incorrect or improper use of any goods, products or services offered by or purchased through the site, including use that does not comply with any product instructions or that would be otherwise unreasonable or unexpected.
  • People of Eden will not be liable in tort (including negligence), contract or otherwise for any direct, special, consequential damages or loss suffered by you arising out of or in connection with this site.
  • You agree to indemnify People of Eden against any liability, actions, claims, demands, damages, costs and expenses incurred or suffered by you in connection with or arising in any way out of your use of this site.
  • People of Eden does not give nor intend to give medical advice. It is your sole responsibility to ensure the products are sufficient and suitable for your purposes and meet your individual needs, and to consult a licensed physician or qualified healthcare practitioner for advice, diagnoses, or treatment of any health-related condition.
  • People of Eden makes no guarantee about the results of your use of the products as results will vary for each individual user. The testimonials and reviews published on the site and corresponding social media sites about our products or services are the opinions of the authors only and are not medical or scientific opinions.

  • People of Eden will not be liable for the content of any third-party sites, including those linked to or from the site. People of Eden does not warrant the offerings of the third-party sites or any other sites linked to or from the site.
  • Your use and access of these third-party sites is at your own risk and you indemnify People of Eden from any harm, loss or damages you may sustain.

10. Force Majeure

  • People of Eden will not be liable for any failure or delay in performing an obligation under this Agreement, to the extent beyond its reasonable control, that is due to any of the following causes:
    • acts of God, including earthquakes, flood, storm, fires, explosions or any other natural disaster;
    • inability to use public or private telecommunication systems;
    • accidents, civil commotions, riots, terrorist attack/s or terrorist threat, war (declared or not) or threat or preparation for wars;
    • government acts or omissions, changes in law or regulations;
    • lack of availability of raw materials; or
    • epidemics, pandemic, including the COVID-19.

11. User Content

  • You understand and accept that People of Eden may use the photographs, images, suggestions, social media posts and shares, ideas, messages, inquiries, date, text or software you submit to the site without compensation. People of Eden will have perpetual, worldwide, unrestricted, royalty-free, irrevocable license to use, copy, license, sublicense, adapt, display, reproduce, and exploit the same for any purpose whatsoever.
  • You permit People of Eden to publish your first name and State or Town with any content provided by you. 

12. Intellectual Property

  • All content on this site, including without limitation graphics, icons, design rights, images, trademarks (registered or not), service marks, audio clips, texts, logos, data compilations and software are the property of People of Eden and its affiliates.
  • All content included on this site is protected by copyright law. All rights not expressly granted herein are reserved.

13. Severability

  • If any part of this Agreement is held to be invalid or unenforceable in any way, the remaining provision will not be affected, and will remain in full force.

14. Applicable Law and Jurisdiction

  • The Terms are governed by and construed in accordance with the laws of the State of Victoria and the Australian Commonwealth. Your use of this site is a concession of your submittance to the jurisdictions of the courts of Victoria or Australia.
